2. Scope and acceptance

2.1. These Terms and Conditions govern the use of the penkovstudio.eu website and the relationship between Penkov Studio and the users and clients of the services we offer.

2.2. Browsing the website is free and does not require registration. By sending an inquiry or ordering a service, the user acknowledges these Terms and Conditions, which are permanently available on this page and can be saved and printed.

2.3. The processing of personal data is governed separately by our Privacy Policy, and the use of cookies by our Cookie Policy. Accepting these Terms and Conditions does not constitute consent to the processing of personal data.

3. Services

3.1. Penkov Studio provides web design, website development and maintenance, SEO and related digital services.

3.2. Information about services and prices on the website is for general information only and is not an offer within the meaning of the Bulgarian Obligations and Contracts Act. The exact scope, timeline, price and payment terms are agreed individually, either through a written quote accepted by the client (including by email) or through a separate written contract.

3.3. Sending a message through the contact form or an inquiry through the project inquiry form does not create any obligation for either party. A contract is concluded when the client accepts the quote in writing (including by email). If an individual contract or quote conflicts with these Terms and Conditions, the individual contract or quote prevails.

3.4. Penkov Studio may refuse to provide a service whose content is contrary to the law, public morals or the rights of third parties.

4. Prices and payment

4.1. Prices are in euro (EUR). Prices shown on the website are indicative; the final price is set out in the individual quote.

4.2. Payment is made by bank transfer or by another method agreed in the quote or contract. The website does not accept online payments.

4.3. Where an advance payment has been agreed, work begins once it has been received.

5. Rights and obligations of the parties

5.1. Penkov Studio undertakes to deliver the service with due care, within the agreed timeline and in line with the client's instructions.

5.2. The client undertakes to provide the necessary materials, access and information in good time and to pay the agreed fee. Any delay on the client's side extends the delivery timeline accordingly.

5.3. The client warrants that they hold the rights to the text, images, logos and other materials they provide, and that using them does not infringe the rights of third parties.

6. Use of the website

6.1. When using the website and its forms, users must not send unlawful, offensive or misleading content, must not use automated tools to send messages in bulk, and must not do anything that could disrupt the operation or security of the website.

6.2. To protect against spam and abuse, form submissions are checked automatically on the server and the number of submissions within a given period is limited. Messages that fail these checks may not reach us.

7. Intellectual property

7.1. The content of the website (text, images, design, logos, graphics) is protected by copyright and belongs to Penkov Studio or to the respective rights holders. Copying, distributing or using it without written permission is prohibited, except where permitted by the Bulgarian Copyright and Related Rights Act.

7.2. Rights in the work created for the client are transferred or licensed once the fee has been paid in full, to the extent agreed in the quote or contract. Penkov Studio may feature the completed project in its portfolio unless the client has expressly objected in writing.

8. Consumers' right of withdrawal

8.1. Where the client is a consumer (a natural person acting outside their trade or profession) and the contract is concluded at a distance (by email, phone or through the website), they may withdraw from the contract within 14 days of its conclusion without giving a reason and without paying compensation (Art. 50 et seq. of the Bulgarian Consumer Protection Act).

8.2. To withdraw, the consumer sends a clear written statement to support@penkovstudio.eu. They may also use the model withdrawal form in Annex 6 to Art. 52(1) of the Consumer Protection Act. Penkov Studio will refund any payments received within 14 days of receiving the statement.

8.3. If the consumer expressly requested that performance begin before the withdrawal period ends, they must pay an amount proportionate to the work carried out up to the time they notified us of their withdrawal (Art. 55(3) of the Consumer Protection Act). The right of withdrawal does not apply once the service has been fully performed, where performance began with the consumer's express prior consent and their acknowledgement that they would lose the right of withdrawal once the contract was fully performed (Art. 57(1) of the Consumer Protection Act).

8.4. Consumers also have all the rights granted by the Bulgarian Consumer Protection Act and the Bulgarian Act on the Supply of Digital Content and Digital Services, which these Terms and Conditions cannot restrict.

9. Complaints

9.1. Complaints that a service does not match what was agreed should be sent to support@penkovstudio.eu with a description of the issue. We will reply within 14 days, and any justified complaint will be remedied free of charge within a reasonable time.

10. Liability

10.1. Penkov Studio takes care to keep the information on the website accurate and up to date, but does not guarantee uninterrupted availability and is not liable for temporary outages caused by circumstances beyond our control (force majeure, provider failures, cyberattacks).

10.2. The website contains links to third-party websites (for example, LinkedIn, GitHub, Facebook and Instagram). Penkov Studio is not responsible for their content or policies.

10.3. Nothing in these Terms and Conditions excludes or limits liability for intent or gross negligence, or the rights of consumers under mandatory provisions of law.

11. Dispute resolution

11.1. The parties will try to resolve any dispute amicably. Consumers may file a complaint with the Commission for Consumer Protection or turn to an alternative dispute resolution body for consumer disputes, namely the General Conciliation Commission and the sector-specific conciliation commissions at the Commission for Consumer Protection (kzp.bg). See our Legal Information page for details.

11.2. These Terms and Conditions are governed by Bulgarian law. Disputes that cannot be settled are resolved by the competent Bulgarian court, subject to the jurisdiction rules that protect consumers under the law.

12. Changes

12.1. Penkov Studio may amend these Terms and Conditions. Changes are published on this page together with the date of the update and do not apply to contracts already concluded unless the client expressly agrees.
